Fatal Accident Claims

Claims for fatal accidents arise when a person has been killed as the result of the wrongdoing or negligence of another, this may be in a road traffic accident, an accident at work or any other circumstances in which the death could have reasonable been prevented.

The Law governing fatal accidents does not aim to punish those responsible, but aims to compensate dependants, beneficiaries and the estate of the deceased for the loss they suffered. Any criminal conviction or prosecution is designed to reprimand those responsible.

Rest assured however, the absence of a criminal conviction is not an automatic bar to claiming compensation.

​

Claims for compensation may be brought by the estate, dependants or beneficiaries within three years of the date of death or date of knowledge that the death was a result of the wrongdoing or negligence of another.
